MEMBER BUSINESS AGREEMENT

The CAPE COD COMMUNITY CLUB has been established to provide residents of Cape Cod with discounts on products and services of designated local businesses on Cape Cod. Such discounts will be honored upon presentation of the CAPE COD COMMUNITY CLUB card. The CAPE COD COMMUNITY CLUB will donate 10% of its club membership fees to a select group of Cape Cod based non-profit organizations.  Each member will designate where they want their money to be pledged at the time of application.

Member Business will provide a discount to Club members.  This Agreement is subject to a mutually agreed upon discount.
 
Agreement will be in effect for (12) twelve months, beginning with the start of the program. An option for an additional 24 months can be exercised by the CAPE COD COMMUNITY CLUB  based upon satisfactory performance of the service. The Merchant will be obligated to honor all valid Club Members for the above period.

The Card must be presented at time of purchase. The  CAPE COD COMMUNITY CLUB  card will be for personal and household use, not for business or commercial use. Member businesses may confiscate any card used by anyone other than the cardholder. The Club has the right to revoke the use of the card for the remainder of the membership year and deny future membership It will be the responsibility of the Member Business to enforce the CLUB’S guidelines.

The CAPE COD COMMUNITY CLUB will include Member Business’s name on website and may, at its discretion, include Merchant Business's name in its advertising.

Member Business agrees to make reasonable effort to display the CAPE COD COMMUNITY CLUB promotional material which may be provided. Member Business agrees to make a reasonable effort to include "Member-Cape Cod Community Club" in their advertising.

Member Business agrees to make a reasonable effort to participate in any CAPE COD COMMUNITY CLUB promotions.

If circumstances present themselves where the Member Business will be unable to continue to participate in the CAPE COD COMMUNITY CLUB’S program, then the Member Business must give (90)  ninety days notice to the CAPE COD COMMUNITY CLUB before withdrawing from the CLUB’S program. They may be required to surrender their Free card(s) or compensate the CAPE COD COMMUNITY CLUB for the outstanding value of the card(s).

Either party may assign this Agreement or any of its rights or obligations hereunder with the prior written consent of the other party.  Any notices or communications under this agreement shall be in writing and shall be delivered to the parties at their addresses set forth herein.  This Agreement, including any attachments hereto, set forth the entire agreement between the parties.  No modification, amendment, supplement to or waiver of this Agreement or any of its provisions shall be binding upon the parties, unless made in writing and duly signed by both parties.  This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts without giving effect to its conflict of laws principles.
